On August 3, 2015, the Office of Federal Contractor Compliance Programs (“OFCCP”) published a new poster. According to OFCCP, the Outreach and Education poster is the result of “feedback received during stakeholder listening sessions.” OFCCP explains that the aim of the poster is to “increase public awareness of OFCCP and its mission,” as well as the obligation of federal contractors to “treat workers fairly and without discrimination, including paying workers fairly.”
The poster is consistent with the Obama Administration’s recent focus on pay equality and transparency and its efforts to impose new obligations on federal contractors in support of those efforts. Specifically, the recent Fair Pay and Safe Workplaces Executive Order includes a pay transparency provision, which requires federal contractors to include certain pay details on every employee’s pay stub. Additionally, Executive Order (“EO”) 13665 prohibits federal contractors from discriminating against employees for sharing compensation information. OFCCP in its announcement did not state that federal contractors are required to post the Outreach and Education poster.
